Arrests

Assault 2nd; Burglary 2nd (2 counts); Menacing 3rd; Endangering the Welfare of a Child, 12:17 AM, Thursday, August 26, 2021, N. Lyon St. – Eric A. SPIKES, M/44, no permanent address, was arrested on a Batavia City Court Arrest Warrant for the above listed charges following an investigation into an incident where he allegedly physically attacked and injured another individual in the presence of multiple children. Spikes was arraigned in Batavia City Court and remanded to Genesee County Jail without bail. Spikes appeared in Batavia City Court on 11/12/2021.  

Criminal Obstruction of Breathing or Blood Circulation; Reckless Endangerment 2nd; Attempted Assault 2nd; Harassment 2nd, 12:50 AM, Sunday, September 5, 2021, E. Main St. – Paul A. INOSTROZA, M/30, of Batavia NY, was arrested on a Batavia City Court Arrest Warrant for the above listed charges following an investigation into an accident where he allegedly physical attacked another individual. Inostroza was arraigned in Batavia City Court by Judge Burns at 10:40a.m., and released under supervision. Inostroza is scheduled to re-appear in Batavia City Court on 11/18/2021 at 1:30p.m.  

Criminal Mischief 3rd; Assault 3rd; Grand Larceny 4th, 3:40 PM, Sunday, November 7, 2021, Liberty St. – On 11/7/2021, Mark B. HAVENS, M/59, of Batavia NY, was arrested on the charges of Assault 3rd, Criminal Mischief 3rd, and Grand Larceny 4th. Charges stem from a domestic incident where Havens allegedly struck a female in the face causing injury, took her cell phone from her person and damaged a computer belonging to her. Havens was processed at the Batavia Police Department, arraigned before Judge Rogers in Batavia City Court and released on recognizance. Havens is due back in Batavia City Court on 11/18/2021 at 2:30p.m. 

Bench Warrant, 10:00 AM, Monday, November 8, 2021, W. Main St. – On 11/8/2021, Philip M. ESCOBAR, M/32 of Kirvin, TX, was arrested on a warrant for failing to appear in Batavia City Court. Escobar was arraigned in City Court and released on recognizance. Escobar is scheduled to appear in City Court at a later date.  

Criminal Possession of a Controlled Substance 7th, 11:58 PM, Friday, November 5, 2021, E. Main St. – Jason L. JOHNSON, M/39 of Batavia NY, was engaged in a physical altercation with another patron at a business on E. Main St. Upon positive identification of Johnson, he was arrested on an unrelated incident. Subsequent to Johnson’s arrest, Johnson was allegedly found to possess crack cocaine, and a broken crack pipe in his pants pocket. Johnson was issued an appearance ticket and released.  

Criminal Mischief 3rd, 10:24 AM, Thursday, November 4, 2021, Watson St. – Jaequele M. TOMLIN, M/26 of Batavia NY was arrested on the above listed charge, after the Batavia Police Department responded to a reported domestic incident on Watson street., where it is alleged that Tomlin damaged property. He was arraigned in Batavia City Court. Tomlin was released on recognizance and is scheduled to return to Batavia City Court on 11/18/2021 at 1:30p.m.  

Driving While Intoxicated: BAC >.08%; Driving While Intoxicated; Failed to Stop at a Stop Sign; Moved from lane Unsafely, 1:00 AM, Saturday, October 30, 2021, E. Main St. – On 10/30/2021, at approximately 1:00AM, Erik POKORNOWSKI, M/30 of Byron NY was arrested after a traffic stop in the City of Batavia. It is alleged that Pokornowski was stopped for several traffic violations and it was found that Pokornowski was allegedly intoxicated by an alcoholic beverage with a BAC of .08% or more. He was issued an appearance ticket to appear in Batavia City Court on a later date.  

Harassment 2nd, 3:45 PM, Wednesday, October 27, 2021, S. Lyon St. – On 10/27/2021, Gilberto N. NATAL, M/33 of Batavia NY was arrested on the above charge. Natal was arrested following a domestic incident on South Lyon Street where he allegedly grabbed another person and threw them to the ground. He was arraigned in Batavia City Court and released on recognizance. He is due back in court on 11/24/2021
