GENESEE COUNTY SHERIFF’S REPORT/December 26, 2021

Brian P. Demko, 44, of Batavia, is charged with DWI, using a leased/rented/loaned vehicle without an interlock device, refusal to take a breath test, a license restriction violation, and operating a motor vehicle with obstructed vision, after being stopped for a vehicle and traffic violation at 6188 Main road in Stafford on December 23, 2021 at 12:36p.m.

After an investigation, it is alleged that Demko was operating a vehicle while intoxicated and operating without a court ordered interlock device.

Demko was transported to the Genesee County Jail for processing and released with appearance tickets. He will appear in Stafford Town Court on January 18, 2022 at 10:00a.m.

Brian T. Durett, 31, of Rochester, is charged with DWI, driving with a BAC of .08% or more, moving from a lane unsafely and speed not reasonable and prudent, a one vehicle accident on Rt. 490 east in LeRoy on December 24, 2021 at 12:39a.m.

Following an investigation of a vehicle into a ditch, it was determined that Durett allegedly operated a vehicle in an intoxicated condition.

He was released on an appearance ticket and will appear in LeRoy Town Court on January 20, 2022 at 5:00p.m.

On December 22, 2021, Jeffery M. Kirkey, 50, of Rochester, and Jessica L. Zicari, 38, of Charlotte, NY, were arrested for criminal possession of a controlled substance, after a complaint of a vehicle partially blocking the roadway on Rt.33 in Stafford.

After an investigation, Kirkey and Zicari were arrested for allegedly possessing a quantity of cocaine.

They were transported to the Genesee County Jail for processing. Zicari was released on her own recognizance and Kirkey was turned over to the Monroe County Sheriff’s Office for an outstanding felony warrant.

Both will appear in Stafford Town Court on January 4, 2022 at 10:00a.m.

Matthew P. Parker, 32, of Batavia, is charged with criminal trespass following a complaint at Walmart, 4133 Veterans Memorial Drive, on December 21, 2021 at 3:02pm.

Parker was processed at the Genesee County Jail for prints and photos and released on an appearance ticket.

He is scheduled to appear in the Town of Batavia Court on January 4, 2022.
