Arrests

Petit Larceny, 12:01 PM, Tuesday, January 4, 2022, E. Main St. – Abigail M. RUSSELL, F/19, of Hamburg NY, was arrested for petit larceny after she allegedly shoplifted at a local grocery store. Russell allegedly filled a bag with numerous food items before leaving the store without paying for them. Russell reportedly fled the scene on foot after being confronted by an employee in the parking lot. She was quickly located in another nearby business by Batavia Police and arrested. Russell was released on an appearance ticket and is scheduled to appear in Batavia City Court on January 24, 2022 at 1:00 PM.

Harassment 2nd Degree, 1:29 PM, Saturday, January 1, 2022, Oak St. – Walter M. RHYNES, M/30, of Rochester, NY, was arrested on the above charge following an incident where he allegedly tried to strike an employee at a local hotel. Rhynes was processed at the scene and issued an appearance ticket. Rhynes is scheduled to appear in Batavia City Court on January 18, 2022 at 1:00 PM.  

Criminal Mischief 4th Degree, 11:10 PM, Tuesday, January 4, 2022, State St. – Brittany N. LEACH, F/28, of Batavia, NY, was arrested on 2 counts of the above charge following an incident where she allegedly damaged a door as well as a vehicle. Leach was issued an appearance ticket and is scheduled to appear in Batavia City Court on January 25, 2022 at 1:00 PM for arraignment.

Arrest Warrant, 9:45 PM, Sunday, April 25, 2021, Clinton St. – Marcus T. HILL, M/29, of East Rochester, NY, was arrested on an arrest warrant from Batavia City Court. The warrant was issued on July 28, 2021, after HILL allegedly failed to appear in court. Hill was arraigned in Batavia City Court and released under the supervision of Genesee Justice. Hill is scheduled to return to Batavia City Court on January 20, 2022 at 1:30 PM.

Obstruction of Governmental Administration; Resisting Arrest; Operate a Motor Vehicle without insurance; Operate a Motor Vehicle with a suspended registration; Operate a Motor Vehicle with an obstructed view, 10:02 PM, Saturday, January 1, 2022, Liberty St. – On January 1, 2022, Officer Post arrested Hailee N. CALLICUTT, F/21, of Batavia, NY, for resisting arrest, obstruction of governmental administration, and multiple vehicle and traffic law violations after a traffic stop on Liberty street. Callicutt was issued appearance tickets and is scheduled to return to Batavia City Court on January 25, 2022 at 1:00 PM.

DWI; Aggravated DWI; Moved from Lane Unsafely, 4:23 PM, Saturday, January 1, 2022, N. Lyon St. – On 1/1/2022, Officer Post arrested Brian GRAZIAPLENA, M/70, of Batavia, NY, for aggravated DWI, following an accident investigation after GRAZIAPLENA allegedly drove his car into a tree. Graziaplena was issued appearance tickets and released to a sober third party with a return court date of January 25, 2022 at 1:00 PM at the Batavia City Court.

Criminal Contempt 2nd, 12:00 PM, Saturday, December 18, 2021, W Main St. – On 1/2/2022, Dean C. SIMINSKI, M/32, of Batavia, NY, was arrested on the above charge. It’s alleged that he sent a letter to the protected party in an order of protection. He was issued an appearance ticket and is scheduled to appear in Batavia City Court on January 4, 2022.
