On February 24, 2022, Roger L. Ballard Jr., a 28-year-old former resident of Castile, NY, was sentenced by Wyoming County Court Judge Michael M. Mohun to 18 years to life in State Prison on his conviction of
Predatory Sexual Assault Against a Child, a class A felony. He was also sentenced to a 7-year determinate prison sentence with 10 years of post-release supervision after being convicted of sexual abuse 1st degree. Additionally, Ballard was also sentenced to the maximum sentence of 364 days in the local jail on the charge of endangering the welfare of a child.
The sentences will run concurrent to one another and the 18 to life sentence will be the controlling sentence which means he will serve at least 18 years in prison before being able to see the parole board.
Ballard Jr. was convicted of these three offenses following a five-day jury trial in December 2021.
Upon release from prison, he will have to register as a sex offender.
The case was prosecuted by Assistant District Attorney Chelsie Hamilton. The defendant was represented by Raymond P. Sciarrino, Esq.
“This is a case of justice delayed but not denied due to the courageous and inspiring strength of the victim. Mr. Ballard should never be allowed out of prison for what he has done,” said Wyoming County District Attorney Donald G. O’Geen.
