PERRY, NY- Chief Michael J. Grover reports the arrest of a Leicester resident on several charges following an investigation by the Perry Police Department.

On March 8th, 2022, at approximately 7:10 pm Officer Spencer Kramell conducted a traffic stop on North
Main Street in the Village of Perry for a vehicle and traffic law violation. Upon interacting with the suspect,
40-year-old Frank A. Biondo III, of Leicester, NY, Officer Kramell suspected Biondo to be intoxicated.

Officer Kramell requested Biondo submit to standardized field sobriety tests, which he complied. Biondo did not perform the tests as instructed and was subsequently arrested for driving while intoxicated. A vehicle inventory search was conducted at which time a suspected prescription medication was discovered in the vehicle. After further investigation it was determined that the medication was in fact a controlled substance. Biondo admitted to not having a prescription for the substance, therefore criminally possessing the substance.

Biondo was processed at the Perry Police Department where he did voluntarily submit to a chemical breath test to determine his blood alcohol content (BAC). The test revealed that Biondo had a BAC of .12%.

After processing, Biondo was released to a sober third party per NYS bail reform laws and is to appear in Perry Village Court on April 12, 2022, on the below charges.

Vehicle and Traffic Law- 1192-3 DWI-Common Law
Vehicle and Traffic Law-1192-2 DWI BAC .08% of 1% or higher
NYS Penal Law- 220.03(2)- Criminal Possession of a Controlled Substance 7th
