Arrests

Unauthorized use of a motor vehicle, 1:40 PM, Saturday, April 2, 2022, S. Main St. – On April 4, 2022, Carrie L. HENSLEY, F/44 of Batavia, NY, was arrested on the above listed charge. The charge stems from a complaint where Hensley allegedly refused to return a vehicle to the owner who had permitted her to borrow it. Hensley was processed and issued an appearance ticket returnable to Batavia City Court on April 26, 2022, at 1:00PM.  

Obscenity in the 3rd degree, 8:20 AM, Thursday, March 31, 2022, Lewis Pl. – On April 2, 2022, Jacob L. HERNANDEZ, M/27, of Batavia NY, was arrested after the Genesee County Sheriff’s Office attempted to locate Hernandez on an outstanding bench warrant. It is alleged that Hernandez fled the scene, leading the Genesee County Sheriff’s Office on a foot pursuit through the woods where he was later detained. Hernandez was then turned over to the City of Batavia Police Department because of an ongoing investigation into a domestic incident where it is alleged that Hernandez sent an individual lewd images of himself. Hernandez was arraigned in City Court and held with bail set on both his active bench warrant and his new charge.    

Harassment 2nd degree, endangering the welfare of a child, 8:03 PM, Saturday, March 26, 2022, Vine St.-Marie I. FRYE, F/57, of Batavia NY, was arrested on the above listed charges. Frye allegedly punched another person while her child was present in the same room. Frye was processed and arraigned in Batavia City Court before Judge Burns and released. Frye is due back in Batavia City Court on April 14, 2022, at 1:30PM.  

Failure to stop at a stop Sign; Obstruction of Governmental Administration 2nd, 4:44 PM, Sunday, April 3, 2022, E. Main St. – Joseph W. FREEMAN, M/37 of Batavia, NY was arrested on the above listed charges following a traffic stop where he allegedly fled from police on his bicycle. Freeman was issued an appearance ticket, returnable to Batavia City Court on April 19, 2022, and released.     

Criminal Contempt 1st, 3:20 PM, Tuesday, March 29, 2022, Tracy Ave. – Dean C. SIMINSKI, M/32, of Batavia NY, was arrested for the above listed charge following an investigation. Siminski allegedly contacted the protected party of an order of protection. Siminski was arraigned in Batavia City Court by Judge Rogers. Siminski was held on $10,000A, $20,000B, and $40,000E. He was transported to the Genesee County Jail where he was held. Siminski is set to return to Batavia City Court on April 13, 2022, at 3:00PM.  

Driving While intoxicated, 8:28 PM, Monday, March 28, 2022, N. Spruce St. – Gina M. OLSZEWSKI, F/29 of Batavia, NY, was arrested for DWI after a vehicle stop, which was made during an investigation into a reported criminal mischief that had just occurred at a local business. Olszewski was processed at the Batavia Police Department and was released on traffic tickets. Olszewski is scheduled to appear in Batavia City Court on April 13, 2022, at 9:00 AM.  

BMCSoliciting Alms on a Public Street or Place, 11:30 AM, Tuesday, March 29, 2022, Alva Pl. – Nancy L. LAWRENCE, F/69 of Batavia, NY, was arrested on the above listed charge following a complaint from an individual reporting that a woman had been begging for money in the Alva Place parking lot. Lawrence was issued a computer-generated appearance ticket, returnable to Batavia City Court on April 19, 2022, at 1:00PM.  

Criminal Mischief 4th, 8:25 PM, Monday, March 28, 2022, E. Main St. – On March 28, 2022, James R. TILLERY, M/49 of Batavia, NY, was arrested for criminal mischief 4th degree after he allegedly damaged property at a local restaurant. Tillery was issued an appearance ticket and released with a return court date April 13, 2022, at 1:00PM in Batavia City Court.    

Criminal Contempt 2nd Degree, 4:02 PM, Monday, March 28, 2022, W. Main St. – On March 28, 2022, Matthew W. KURTZ, M/52, of Batavia, NY, was arrested on the charge of criminal contempt 2nd degree. Kurtz allegedly had third party contact with a person who has an order of protection against him. Kurtz was processed and issued an appearance ticket returnable to Batavia City Court on April 19, 2022, at 1:00 PM.  

Resisting Arrest; Obstructing Governmental Administration 2nd, 12:03 PM, Friday, March 4, 2022, W. Main St. – Jolene Y. STEVENS, F/33 of Batavia, NY, was arrested on the above listed charges after fighting with the police while they executed a bench warrant for her arrest. Stevens was arraigned in Batavia City Court in front of Judge Burns and released. Stevens was scheduled to return to court on April 7, 2022, at 1:30 PM. 

Unlawful Dissemination of an Intimate Image, 5:00 PM, Sunday, March 20, 2022, Porter Ave. – On March 21, 2022, Officer POST arrested Raven M. SPIKES, F/20 of Batavia, NY for unlawful dissemination of an intimate image after she allegedly posted a video of sexual conduct on a social media site. Spikes was issued an appearance ticket with a return court date of April 5, 2022, at 1:00PM.
