WYOMING COUNTY SHERIFF’S REPORT/Man facing felony aggravated DWI charges under Leandra’s Law after traffic stop for speeding in Sheldon

Lowell C. Lacy, 41, of Far Rockaway, NY, was arrested after he was stopped for speeding on Route 20A in the Town of Sheldon on August 30, 2022. Lacy was allegedly driving at a rate of 57MPH in a 35MPH speed zone, and during the traffic stop the odors of an alcoholic beverage and burned cannabis were detected coming from within the vehicle.

Two children, ages 6 and 10, were both found to allegedly be improperly restrained in the back seat of the vehicle. Lacy performed poorly on standardized field sobriety testing, and was taken into custody. The children, and another sober adult passenger, were transported to a local hotel, due to no valid driver being in the vehicle. The vehicle was towed from the scene, and Lacy was taken to the Wyoming County Sheriff’s Office for processing.

Lacy is charged with aggravated DWI/child in vehicle, 2 counts, a class E felony, DWI, driving with .08% BAC or higher, consumption of cannabis in a motor vehicle, speeding in a zone, back seat passenger/age 4-6- improper restraint, and back seat passenger/age 7-15- improper restraint

Lacy was issued an appearance ticket and is scheduled to answer the charges in the Town of Sheldon Court on September 20, 2022. Lacy was then released to the sober adult passenger.
