BATAVIA POLICE BLOTTER/Homeless man allegedly breaks into a business then steals a vehicle, leading police on a high-speed chase

Grand Larceny 3rd; Unauthorized Use of a Motor Vehicle; Burglary 3rd, 7:29 AM, Tuesday, October 25, 2022, Bank St. – Shawn R. WISNIEWSKI, M/33, homeless, was arrested on the above listed charges. Officers were called to a parking lot on Bank street for a male who was attempting to get into vehicles.

Shortly following the initial suspicious person call, dispatchers received another call reporting that a vehicle had been stolen from the same parking lot. The vehicle was then observed traveling westbound on West Main street in the area of Denny’s and failed to stop for patrols.

After the pursuit was terminated, the vehicle was located in East Pembroke along with the suspect. Through an investigation, officers learned that WISNIEWSKI had allegedly broken into a business office on Washington avenue prior to allegedly stealing the vehicle.

WISNIEWSKI was arrested and arraigned in Batavia City Court and was held on $25,000 cash bail, $50,000 bond and $100,000 partially secured.

WISNIEWSKI is due back in court on November 15, 2022 at 3:00 PM.

Trespass, 10:25 AM, Monday, October 24, 2022, Cherry St. – Linda L. BETTIES, F/59, of Batavia, NY, was arrested on the above charge. Police were called to a residence on Cherry street for a trespass complaint.

Upon further investigation, BETTIES was found to have allegedly trespassed upon a property in which she had previously been told to stay off of. She was arrested and issued an appearance ticket. BETTIES is due in Batavia City Court on November 8, 2022 at 1:00 PM.

Bench Warrant: Failure to appear on an Appearance Ticket, 11:20 AM, Friday, March 11, 2022, Summit St. – On 10/25/2022, Brian M. RAPHAEL, M/34, of Batavia, NY, was arrested on a bench warrant after he failed to appear in court. RAPHAEL was also arrested on two arrest warrants after he failed to appear in court after receiving two appearance tickets. RAPHAEL was arraigned in Batavia City Court on October 25, 2022 at 9:45 AM. RAPHAEL was held at the Genesee County Jail on $5,000 cash, $10,000 bond, and $25,000 surety bond, to appear in Batavia City Court on November 3, 2022 at 1:30 PM.

Harassment 2nd Degree: Criminal Possession of a Controlled Substance 7th, 1:46 AM, Sunday, October 23, 2022, W. Main St. – John SUMLIN III, M/43, of Batavia, NY, was arrested on the listed charges on October 23, 2022. SUMLIN is alleged to have struck a female victim in the neck during a domestic incident.

SUMLIN is also alleged to have been in the possession of a controlled substance.

He was arraigned in Batavia City Court by Judge BURNS at 4:16 AM. SUMLIN was released on recognizance and is scheduled to appear in Batavia City Court on November 3, 2022 at 1:30 PM.

Harassment 2nd, 2:00 PM, Sunday, October 23, 2022, W. Main St. – On 10/23/2022, James A. COLANTONIO, M/53, of Batavia, NY, was arrested for harassment 2nd after an alleged argument with a co-worker. COLANTONIO was issued an appearance ticket with a return court date of November 15, 2022 at 1:00 PM to Batavia City Court.

Criminal Mischief 4th, 12:20 AM, Saturday, October 1, 2022, Jackson St. – Kyle J. SCHROEDER, M/25, of Batavia, NY, was arrested on the above listed charge following an investigation into a complaint where he allegedly damaged property at a local business on October 1, 2022.

SCHROEDER was arraigned in Batavia City Court and released under the supervision of Genesee Justice.

He is scheduled to appear in Batavia City Court on November 3, 2022.

Criminal Contempt 2nd, 8:00 PM, Sunday, October 23, 2022, W. Main St. – On the above date and time, Isaiah L. POOLE, M/22, of Albion, NY, was arrested on an arrest warrant out of Batavia City Court for Criminal Contempt 2nd. POOLE was arraigned in Batavia Town Court, and held on bail, to appear in Batavia City Court on October 26, 2022 1:00 PM.

Criminal Mischief 3rd, 8:13 AM, Thursday, July 21, 2022, N. Spruce St. – On 10/21/2022, Johnnie M. WASTON, M/39, of Batavia, NY, was arrested at 1 W. Main street for criminal mischief in the 3rd degree after he allegedly damaged the property of another person at a local residence.

WASTON was arraigned in Batavia City Court on October 21, 2022 at 11:15 AM and was released on his own recognizance and will appear in Batavia City Court on November 10, 2022 at 1:30 PM.  

Failure to appear on Appearance Ticket, 5:54 PM, Monday, June 13, 2022, E. Main St. – On 10/21/2022, Johnnie M. WASTON, M/39, of Batavia, NY, was arrested at 1 W. Main St. for failure to appear after an appearance ticket was issued. WASTON was arraigned in Batavia City Court on October 21, 2022 at 11:15 AM and was released on his own recognizance. He will re-appear in Batavia City Court on November 10, 2022 at 1:30 PM.  

Burglary 3rd; Grand Larceny 4th, 6:58 AM, Sunday, October 9, 2022, E. Main St. – Joseph T. MARTINO, M/30, homeless, was arrested on the above listed charges on an unrelated matter on Walnut street.

It is alleged that MARTINO entered a local business to commit a crime therein and stole merchandise in excess of $1,000.

MARTINO was arraigned in Batavia City Court by Judge BURNS and was held on $5,000A, $10,000B, and $20,000 E.

MARTINO was transported to the Genesee County Jail where he was held. He appeared in Batavia City Court on October 27, 2022 at 1:30 PM.
