GENESEE COUNTY/Batavia man facing felony rape charges involving a victim under 17

Joe A. Cortez, 40, homeless, of Batavia, NY, is charged with rape 1st degree, a class B violent felony, and rape 3rd degree, a class E felony, after an investigation into a sex offense that occurred in the town of Batavia on September 20, 2022.

Cortez was arrested on January 6, 2023. He allegedly forcibly had sexual intercourse with a juvenile victim under the age of 17.

Cortez was arraigned in accordance with the Central Arraignment Part (CAP) Court procedures and held at the Genesee County Jail. He will appear in Batavia Town Court on January 24, 2023.

  1. The DA should’ve done their job. This monster almost killed my mother while holding his son who was only 6mo at the time. He’s 4now. Countless emails, phone calls unanswered. Court dates pushed back and were still waiting with no word. Hours upon hours spent trying to prevent him from hurting another human being.
