WYOMING COUNTY/Man on parole found guilty of manufacturing methamphetamine

On Friday, January 20, 2023, Dain O. KiIian, 39, a former resident of Warsaw, NY, was found guilty, following a two-day bench trial before the Honorable Keith Kibler, of unlawful manufacture of methamphetamine in the second degree, a class C felony, and criminal possession of a controlled substance in the seventh degree, a class A misdemeanor.

Kilian will be sentenced on March 17, 2023 at 9:30a.m., and was held without bail. He faces up to eight years in prison and three years post release supervision.

Kilian was arrested after his parole officer visited him on March 3, 2022. Kilian was on parole as a result of an August 3, 2021 conviction for unlawful manufacture of methamphetamine in the third degree.

Following the parole officer’s discovery of a controlled substance in his possession, NYS Police Troopers, as well as Wyoming County Sheriff’s Deputies arrived on scene. After a search warrant was obtained, the NYSP Contaminated Crime Scene Emergency Response Team (CCSERT) searched Kilian’s room and located a number of items used for the manufacturing of methamphetamines.

“Methamphetamine and Opioids continue to have a devastating impact on our community. Mr. Killian has been a major player in that impact. We will continue to aggressively hold those manufacturing or dealing in methamphetamine accountable. These meth labs also put our law enforcement community at risk due to the potential hazard that these labs create. Due to the instability of meth labs a specialized New York State Police unit (CCSERT) was called in to assist,” said First Assistant District Attorney Vincent Hemming.

The case was prosecuted by Assistant District Attorney Vincent Hemming. Joseph Terranova, Esq. represented the defendant.
