WYOMING COUNTY/Sheldon man pleads guilty to course of sexual conduct against a child

On January 25, 2022, Roger Bartz, 73, of Sheldon, NY waived indictment and pleaded guilty in Wyoming County Court to the charge of Course of Sexual Conduct against a Child in the First Degree, a class B violent felony, before the Hon. Michael M. Mohun. The charge carries a maximum sentence of 25 years in prison.

Bartz admitted to committing two or more acts of sexual conduct over the course of an 11-month time frame, between November 10, 2021 and October 23, 2022 with one of those acts being an act of oral sexual conduct. This involved a child who was 6 years of age when the abuse started.

As part of the plea agreement, Bartz will be sentenced on April 20, 2023 at 10:00 a.m. to a 10-year determinate sentence followed by 10 years of post-release supervision. If Bartz is released from jail he will be subject to the sex offender registration act. He also agreed to waive his right to appeal.

The matter was handled by Wyoming County District Attorney Donald O’Geen and Assistant Public Defender Norman Effman.

“This plea agreement is effectively a life sentence. He will be in his 80’s before he is even eligible for release and in the event that he survives his prison term he will be under the supervision of parole until he is in his early 90’s. He will also be subject to the sex offender registration requirements for the rest of his life. This sentence ensures justice for the victim and her family while at the same making sure he will never harm another child again,” said Wyoming County District Attorney Donald O’Geen.
