PERRY POLICE REPORT/Painted Post man charged after investigation into sexual acts/Buffalo woman jailed on drug charges

Chief Michael J. Grover reports the arrest of a Painted Post resident after an investigation by the Perry Police Department.

On January 27, 2023, Sergeant Russell of the Perry Police Department along with Chief Hoffmeister and Sergeant Linderman of the Warsaw Police Department, arrested Austin M. Gardner, 24, of Painted Post, NY, on a warrant issued by the Perry Village Court.

It is alleged that Gardner forcefully made another person unwillingly engage in sexual acts between 2020 and 2021. The incidents allegedly continued after he moved to Warsaw, NY. Gardner is also charged with violating a court order after one had been put in place in November of 2022.

Gardner is charged with criminal sexual act 1st degree/forcible compulsion, a class B felony and failure to obey a court mandate.

He was arraigned in front of the Honorable Mark Sundt in Perry Court where he was committed to the Wyoming County Jail without bail.

Gardner is set to appear in Perry Village Court on 02/07/2023 at 1:00PM.

Chief Michael J. Grover reports the arrest of a Buffalo resident on several charges following an investigation by the Perry Police Department.

On February 1, 2022, at 10:44p.m., Officers Kramell and Anderson conducted a traffic stop on Short Street for multiple vehicle and traffic violations. Upon interacting with the operator, 34-year-old Courtney L. Hoelscher, of Buffalo, NY, it was discovered that Hoelscher had a suspended NY license.

While placing Hoelscher in custody, various drugs were allegedly discovered on her person. She was taken into custody without any incident. A search of Hoelscher’s vehicle resulted in the alleged discovery of more drugs as well as a large amount of cash and several syringes.

Hoelscher was transported to Perry Police Department for interview and processing. During the investigation, it was discovered that Hoelscher had allegedly intended on selling/distributing the drugs. Hoelscher was allegedly in possession of crack-cocaine, methamphetamine, heroin, and Xanax.

Hoelscher is charged with two counts of criminal possession of a controlled substance 3rd degree, a class B felony, criminal possession of a controlled substance 5th degree, a class D felony, criminal possession of a controlled substance 7th degree, aggravated unlicensed operation 3rd degree, aggravated unlicensed operation 2nd degree, unlicensed driver, and improper/unsafe turn without a signal.

Due to the felony level charges, Hoelscher was arraigned in Perry Village Court before Judge Tammy Kelsey with the Public Defender’s Office present for representation. The Wyoming County District Attorney’s Office provided a bail recommendation of $10,000/$20,000/$40,000. Hoelscher was remanded to Wyoming County Jail on that recommendation.

Hoelscher is due back in Perry Village Court on 03/07/2023 to answer to the charges.
