THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, MONE N. WIGGINS, of the crime of GRAND LARCENY IN THE FOURTH DEGREE, contrary to Penal Law Section 155.30(1), a class E felony, in that she, the said MONE N. WIGGINS, on or about the 6th day of January,
2023, while at Ulta Beauty, located at 4192 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, did steal property having a value exceeding one thousand dollars.
COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, MONE N. WIGGINS, the crime of CONSPIRACY IN THE FIFTH DEGREE, contrary to Penal Law Section 105.05(1), a class A misdemeanor, in that she, the said MONE N. WIGGINS, on or about the 6th day of January, 2023,
while at Ulta Beauty, located at 4192 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, with intent that conduct constituting a felony be performed, agreed with one or more persons to engage in or cause the performance of such conduct.
COUNT THREE:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, MONE N. WIGGINS, the crime of CRIMINAL IMPERSONATION IN THE SECOND DEGREE, contrary to Penal Law Section 190.25(1), a class A misdemeanor, in that she, the said MONE N. WIGGINS, on or about the 6th day of January, 2023, while at Ulta Beauty, located at 4192 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, impersonated another and did act in such assumed character with intent to obtain a benefit or injure or defraud another.

RICHARDS, on or about the 4th day of October, 2022, in the City of Batavia, County of Genesee, State of New York, did steal property having a
value exceeding one thousand dollars.

AND THE GRAND JURY OF AFORESAID, by this Indictment, further accuses the Defendant, JACOB A. RICHARDS, of the crime of CRIMINAL POSSESSION OF A FORGED INSTRUMENT IN THE SECOND DEGREE, contrary to penal Law Section 170.25, a class D felony, in that he, the said JACOB A. RICHARDS, on or about the 4th day of October, 2022, in the City of Batavia, County of Genesee, State of New York, with knowledge that it was forged and with intent to defraud, deceive or injure another, uttered or possessed a forged instrument of a kind specified in Section 170.10, to wit: a Tonawanda Valley Federal Credit Union check.

BROWN, of the crime of GRAND LARCENY IN THE FOURTH DEGREE, contrary to Penal Law Section 155.30(1), a class E felony, in that they, the said ANGELA N. BENNETT AND SHAMYA I. BROWN, on or about the 23rd day of May, 2022, while at Dick’s Sporting Goods, located at 4180 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, did steal property having a value exceeding one thousand dollars.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the defendant, LANCE M. MERCADO, SR., of the crime of CRIMINAL POSSESSION OF A WEAPON IN THE THIRD DEGREE, a class D felony, contrary to Penal Law Section 265.02(1), in that he, the said LANCE M. MERCADO, SR., on or about the 29th day of October, 2022, in the Town of Alexander, County of Genesee, State of New York, knowingly possessed metal knuckles.

KEVIN T. FINNELL, District Attorney of Genesee County, hereby accuses LANCE M. MERCADO, SR., of having been convicted of the crime of CRIMINAL SALE OF A CONTROLLED SUBSTANCE IN THE FOURTH DEGREE, contrary to Penal Law Section 220.34-1, a class C felony, on or about the 21st day of June,
2018, in County Court, County of Wyoming, State of New York and said conviction forms the basis for the Indictment filed herewith.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, ETHAN M. CONRAD, of the crime of DRIVING WHILE INTOXICATED, AS A CLASS E FELONY, contrary to Vehicle and Traffic Law Sections 1192-3 and in that he, the said ETHAN M. CONRAD, on or about the 16th day of February, 2023, in the Town of Batavia, County of Genesee and State of New York, did operate a motor vehicle, to wit: a 2013 Volkswagen, on South Main Street Road, a public highway, while he, ETHAN M. CONRAD, was in an intoxicated condition.
