GENESEE COUNTY SHERIFF’S REPORT/Man involved in Batavia standoff in July, now facing charges with the Sheriff’s Department

Akeem R. Gibson, 33, of W. Main St. Rd., Batavia, NY, is charged with reckless endangerment 1st degree, a class D felony and unlawful fleeing a police officer in a motor vehicle 3rd degree, after allegedly fleeing from Sheriff’s Deputies in a vehicle on July 30, 2023 on Walkers Corners Road in the Town of Byron.

Gibson was held at the Genesee County Jail pending a CAP Court arraignment on August 16, 2023.

Mark L. Frongetta, 53, of Park Rd., Batavia, NY, is charged with disorderly conduct after a complaint at the Best Western Inn and Suites at 8210 Park Road on August 14, 2023 at 6:14p.m.

Frongetta allegedly intentionally caused a public inconvenience and annoyance by yelling obscenities. in the hotel lobby and then throwing the hotel’s phone.

Frongetta was held for CAP Court and is to appear in the Town of Batavia Court on August 22, 2023 at 3:00p.m. in front of Judge Young.

Jason M. Babbitt, 49, of Perry Rd., Pavilion, NY, is charged with 42 counts of aggravated harassment 2nd degree, after allegedly contacting the Genesee County Dispatch Center by phone numerous times after being instructed to stop calling on July 22, 2023 at 1:15a.m.

Babbitt’s calls were harassing in nature and did not require the service of police, fire or EMS. Babbit was issued an appearance ticket in the matter and will appear in the City of Batavia Court on August 29, 2023.

Angel E. Colon, 41, of Grant St., North Tonawanda, NY, is charged with harassment 2nd degree following an investigation into Colon allegedly spitting on a person’s face while at the Genesee County Jail at 14 West Main Street in Batavia on August 16, 2023.

Colon was issued an appearance ticket and will appear in the City of Batavia Court on August 29, 2023 at 1:00p.m.

Jose E. Velez-Torress, 42, of Sobieski St., Rochester, NY, is charged with two counts of criminal possession of a controlled substance 7th degree, speeding in a 55mph zone, aggravated unlicensed operation 3rd degree, operating a motor vehicle with improper plates and operating without insurance, following a traffic stop on Clinton Street Road in Bergen on August 14, 2023 at 1:19a.m.

Velez-Torres was issued multiple universal traffic tickets and will appear in the Town of Bergen Court on September 13, 2023 at 5:00p.m.

Jacob P. Wetherwax, 25, of Durfee Rd., Wyoming, NY, is charged with DWI, driving with a BAC of .08% or more, moving from a lane unsafely and an equipment violation-no/inadequate lights, following a traffic stop on Rt. 20 in the Town of Alexander on August 18, 2023 at 9:00p.m.

Wetherwax was issued uniform traffic tickets on all charges and released. He is to appear in the Town of Alexander Court on September 5, 2023 at 5:00p.m.

Dennis E. Biggins Jr., 48 of Franklin St., Batavia, NY, is charged with DWI, aggravated DWI, driving with a BAC of .18% and driving too slow/impeding traffic, while driving on Rt. 237 in Stafford on August 14, 2023 at 4:15p.m.

Biggins was issued an appearance ticket and is scheduled to appear in Stafford Town Court on September 5, 2023 at 10:00a.m.

Joseph A. Boisclair, 58, of Knowlesville Rd., Oakfield, NY, is charged with DWI, speeding in a zone, driving to the left of pavement markings and failure to keep right on a two-lane road, after a traffic stop on Lewiston Road in Batavia on August 19, 2023 at 1:35a.m.

Boisclair was released on traffic tickets and is scheduled to appear in Batavia Town Court on September 7, 2023 at 1:00p.m.

    How many times does someone have to commit serious crime before they put them in prison these days? A prior crime history, held a hostage and destroyed property a few months ago, and now this.
