GENESEE COUNTY/Indictments/Man who fled from police and involved in a standoff has been indicted

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, AKEEM R. GIBSON, of the crime of RECKLESS ENDANGERMENT IN THE FIRST DEGREE, contrary to Penal Law Section 120.25, a class D felony, in that he, the said AKEEM R. GIBSON, on or about the 30th day of July, 2023, on Walkers Corners Road, in the Town of Byron, County of Genesee, State of New York, under circumstances evincing a depraved indifference to human life, recklessly engaged in conduct which created a grave risk of death to another person, to wit: he drove a vehicle into oncoming traffic.

COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, AKEEM R. GIBSON, of the crime of UNLAWFUL FLEEING A POLICE OFFICER IN A MOTOR VEHICLE IN THE THIRD DEGREE, contrary to Penal Law Section 270.25, a class A misdemeanor, in that he, the said AKEEM R. GIBSON, on
or about the 30th day of July, 2023, in the Town of Byron, County of Genesee, State of New York, knowing that he had been directed to stop his motor vehicle by an uniformed police officer or a marked police vehicle by the activation of either lights or lights and sirens of such vehicle did attempt to flee such officer or such vehicle by driving at speeds which equal or exceed twenty-five miles per hour above the speed limit.

COUNT THREE:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, AKEEM R. GIBSON, of the offense of SPEEDING, contrary to Vehicle and Traffic Law Section 1180(d)(I), in that he, the said AKEEM R. GIBSON, on or about the 30th day of July, 2023, did operate a motor vehicle, to wit: a 2012 Toyota, bearing New York State License Plate No. ——-, on Walkers Corners Road, a public highway, in the Town of Byron, County of Genesee, State of New York, in excess of the maximum established speed limit when no exception applied.

COUNT FOUR:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, AKEEM R. GIBSON, of the crime of CRIMINAL TRESPASS IN THE SECOND DEGREE, contrary to Penal Law Section 140.15, a class A misdemeanor, in that he, the said AKEEM R. GIBSON, on or about the 30th day of July, 2023, in the
City of Batavia, County of Genesee, State of New York, knowingly entered or remained unlawfully in a dwelling, to wit: 335 Bank Street, Apt. —.

COUNT FIVE:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, AKEEM R. GIBSON, of the crime of RESISTING ARREST, contrary to Penal Law Section 205.30, a class A misdemeanor, in that he, the said AKEEM R. GIBSON, on or about 30th day of July, 2023, in the City of Batavia, County of Genesee, State of New York, intentionally prevented or attempted to prevent a police officer from effecting an authorized arrest of himself or another person.

COUNT SIX:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, AKEEM R. GIBSON, of the crime of OBSTRUCTING GOVERNMENTAL ADMINISTRATION IN THE SECOND DEGREE, contrary to Penal Law Section 195.05, a class A misdemeanor, in that he, the said AKEEM R. GIBSON, on or about the 30th day of July, 2023, in the City of Batavia, County of Genesee, State of New York, intentionally obstructed, impaired or perverted the administration of law or other governmental function or prevented or attempted to prevent a public servant from performing an official function by means of intimidation, physical force or interference or by means of any independently unlawful act.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment accuses the Defendants, NAHZAIRE N. MURRAY and DEZIRAE J. MARTIN, of the crime of GRAND LARCENY IN THE THIRD DEGREE, a class D felony, contrary to Penal Law Section 155.35(1), in that they, the said NAHZAIRE N. MURRAY and DEZIRAE J. MARTIN, on or about the 24th day of May, 2023, while at Ulta Beauty, located at 4192 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, did steal property having
a value in excess of three thousand dollars.

COUNT TWO:
AND THE GRAND JURY OF AFORESAID, by this Indictment, further accuses the Defendants, NAHZAIRE N. MURRAY and DEZIRAE J. MARTIN, of the crime of CONSPIRACY IN THE FIFTH DEGREE, a class A misdemeanor, contrary to Penal Law Section 105.05(1), in that they, the said NAHZAIRE N.
MURRAY and DEZIRAE J. MARTIN, on or about the 24th day of May, 2023, in the Town of Batavia, County of Genesee and State of New York, with intent that conduct constituting a felony be performed, agreed with one or more persons to engage in or cause the performance of such conduct.

BROADBENT, of the crime of GRAND LARCENY IN THE FOURTH DEGREE, contrary to Penal Law Section 155.30(4), a class E felony, in that she, the said JAMIE L. BROADBENT, on or about the 20th day of March, 2023, in the Town of Batavia, County of Genesee, State of New York, did steal property which consisted of a credit card, to wit: a Discover card belonging to ————.

COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, JAMIE L. BROADBENT, of the crime of GRAND LARCENY IN THE FOURTH DEGREE, contrary to Penal Law Section 155.30(4), a class E felony, in that she, the said JAMIE L. BROADBENT, on or about the 20th day of March,
2023, in the Town of Batavia, County of Genesee, State of New York, did steal property which consisted of a debit card, to wit: a Tonawanda Valley Federal Credit Union card belonging to ————.

COUNT THREE:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, JAMIE L. BROADBENT, of the crime of GRAND LARCENY IN THE FOURTH DEGREE, contrary to Penal Law Section 155.30(4), a class E felony, in that she, the said JAMIE L. BROADBENT, on or about the 20th day of March,
2023, in the Town of Batavia, County of Genesee, State of New York, did steal property which consisted of a credit card, to wit: a Kohl’s card belonging to ————–

COUNT FOUR:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, JAMIE L. BROADBENT, the crime of GRAND LARCENY IN THE FOURTH DEGREE, contrary to Penal Law Section 155.30(4), a class E felony, in that she, the said JAMIE L, BROADBENT, on or about the 20th day of March,
2023, in the Town of Batavia, County of Genesee, State of New York, did steal property which consisted of a credit card, to wit: a Target card belonging to ———–.

COUNT FIVE:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, JAMIE L. BROADBENT, the crime of GRAND LARCENY IN THE FOURTH DEGREE, contrary to Penal Law Section 155.30(4), a class E felony, in that she, the said JAMIE L. BROADBENT, on or about the 20th day of March,
2023, in the Town of Batavia, County of Genesee, State of New York, did steal property which consisted of a credit card, to wit: a Home Depot card belonging to ———-.

COUNT SIX:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, JAMIE L. BROADBENT, the crime of PETIT LARCENY, contrary to Penal Law Section 155.25, a class A misdemeanor, in that she, the said JAMIE L. BROADBENT, on or about the 20th day of March, 2023, in the Town of Batavia, County of Genesee, State of New York, did steal property belonging to another,
to wit: a wallet belonging to ———–.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the defendant, CODY A. BUSH, of the crime of CRIMINAL POSSESSION OF A WEAPON IN THE THIRD DEGREE, a class D felony, contrary to Penal Law Section 265.02(1), in that he, the said CODY A. BUSH, on or about the 22nd day of April, 2023, in the City of Batavia, County of Genesee, State of New York, possessed a dangerous instrument, to wit: a knife, with intent to use the same unlawfully against another.

COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the said, CODY A. BUSH, of the crime of MENACING IN THE SECOND DEGREE, a class A misdemeanor, contrary to Penal Law Section 120.14(1), in that he, the said CODY A. BUSH, on or about the 22nd day of April, 2023, in the City of Batavia, County of Genesee, State of New York, intentionally placed or attempted to place another person,
———–, in reasonable fear of physical injury, serious physical injury or death by displaying a dangerous instrument, to wit: a knife.

Special Information

KEVIN T. FINNELL, District Attorney of Genesee County, hereby accuses CODY A. BUSH, of having been convicted of the crimes of BURGLARY IN THE THIRD DEGREE, contrary to Penal Law Section 140.20, a class D felony and CRIMINAL CONTEMPT IN THE SECOND DEGREE, contrary to Penal Law Section 215.50(3), a
class A misdemeanor, on or about the 1st day of February, 2022, in County Court, County of Genesee, State of New York and said conviction forms the basis for Count One of the Indictment filed herewith.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, ROBERT D. GRIFFIN, of the crime of DRIVING WHILE INTOXICATED, a class E felony, contrary to Vehicle and Traffic Law Sections 1192-3 and in that he, the said, ROBERT D. GRIFFIN, on or about the 19th day of July, 2023, in the City of Batavia, County of Genesee and State of New York, did operate a motor vehicle, to wit: a 2006 Ford, bearing New York State License Plate No, ——–, on Ellsworth Avenue, a public highway, while he, ROBERT D. GRIFFIN, was in an intoxicated condition.

COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, ROBERT D. GRIFFIN, of the crime of CRIMINAL MISCHIEF IN THE FOURTH DEGREE, a class A misdemeanor, contrary to Penal Law Section 145.00(1), in that he, the said ROBERT D. GRIFFIN, on or about the 19th day
of July, 2023, while at the City of Batavia Police Department Headquarters, located at 10 W. Main Street, in the City of Batavia, County of Genesee, State of New York, having no right to do so nor any reasonable ground to believe that he had such right, intentionally damaged property of another person, to wit: a wall in an interview room of the Batavia City Police Department.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, CHRISTOPHER S. USSELMAN, of the crime of CRIMINAL MISCHIEF IN THE THIRD DEGREE, a class E felony, contrary to Penal Law Section 145.05(2), in that he, the said CHRISTOPHER S. USSELMAN, on or
about the 18th day of April, 2023, while at the Genesee County Jail, located at 14 West Main Street, in the City of Batavia, County of Genesee, State of New York, with intent to damage property of another person, and having no right to do so nor any reasonable ground to believe that he had such right, he damaged
property of another person in an amount exceeding two hundred and fifty dollars, to wit: caused damage to a table by kicking it.

COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the Defendant, CHRISTOPHER S. USSELMAN, of the crime of OBSTRUCTING GOVERNMENTAL ADMINISTRATION IN THE SECOND DEGREE, a class A misdemeanor, contrary to Penal Law Section 195.05, in that he, the said CHRISTOPHER S. USSELMAN, on or about the 18th day of April, 2023, while at the Genesee County Jail, located at 14 West Main Street, in the City of Batavia, County of Genesee, State of New York, intentionally obstructed, impaired or perverted the administration of law or other governmental function or prevented or attempted to prevent a public servant from performing an official function by means of intimidation, physical force or interference or by means of any independently unlawful act.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, RUSSELL R. LAWRENCE, of the crime of CRIMINAL POSSESSION OF STOLEN PROPERTY IN THE FOURTH DEGREE, contrary to Penal Law Section 165.45(5), a class E felony, in that he, the said RUSSELL R. LAWRENCE, on or about the 3rd day of June, 2023, in the Town of LeRoy, County of Genesee, State of New York, did knowingly possess stolen property, with intent to benefit himself or a person other than the owner thereof or to impede the recovery by an owner thereof, when the value of the property exceeded one
hundred dollars and the property consisted of a motor vehicle, as defined in section one hundred twenty-five of the vehicle and traffic law, other than a motorcycle, as defined in section one hundred twenty-three of such law, to wit: a 2005 Chevrolet Silverado.

COUNT TWO:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the said, RUSSELL R. LAWRENCE, of the crime of RECKLESS ENDANGERMENT IN THE FIRST DEGREE, contrary to Penal Law Section 120.25, a class D felony, in that he, the said RUSSELL R. LAWRENCE, on or about the 3rd day of June, 2023, on Lake Street, in the Town of LeRoy, County of Genesee, State of New York, under circumstances evincing a depraved indifference to human life, recklessly engaged in conduct which created a grave risk of death to another person, to wit: drove a motor vehicle through intersection(s) in LeRoy, New York, nearly colliding with motor vehicles who were lawfully entering or within the intersection.

COUNT THREE:
AND THE GRAND JURY AFORESAID, by this Indictment, further accuses the said, RUSSELL R. LAWRENCE, of the crime of UNLAWFUL FLEEING A POLICE OFFICER IN A MOTOR VEHICLE IN THE THIRD DEGREE, contrary to Penal Law Section 270.25, a class A misdemeanor, in that he, the said RUSSELL R. LAWRENCE, on or about the 3rd day of June, 2023, in the Town of LeRoy, County of Genesee, State of New York, knowing that he had been directed to stop his motor vehicle by an uniformed police officer or a marked police vehicle by the activation of either lights or lights and sirens of such vehicle did attempt to flee
such officer or such vehicle by driving at speeds which equal or exceed twenty- five miles per hour above the speed limit.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, BRIANNA N. GREENE, of the crime of BAIL JUMPING IN THE SECOND DEGREE, a class E felony, contrary to Penal Law Section 215.56, in that, on or about the 20th day of December, 2022, the said BRIANNA N. GREENE, having by Court order, been released from custody or allowed to remain at liberty, either upon bail or upon her own recognizance, upon condition that she would subsequently appear personally in the Batavia Town Court in and for the County Of Genesee, State of New York, in connection with a charge
against her of committing a felony, did not appear personally on the required date or voluntarily within thirty days thereafter.

THE GRAND JURY OF THE COUNTY OF GENESEE, by this Indictment, accuses the Defendant, BRIANNA N. GREENE, of the crime of GRAND LARCENY IN THE FOURTH DEGREE, contrary to Penal Law Section 155.30(1), a class E felony, in that she, the said BRIANNA N. GREENE, on or about the 8th day of January, 2022, while at Dick’s Sporting Good, located at 4180 Veterans Memorial Drive, in the Town of Batavia, County of Genesee, State of New York, did steal property having a value exceeding one thousand dollars.

The fact that a defendant has been charged with a crime is merely an accusation, and the defendant is
presumed innocent until and unless proven guilty.
