The Grand Jury of The County Of Genesee, by this Indictment, accuses the Defendant, Josia G. Culver, of the crime of BURGLARY IN THE THIRD DEGREE, contrary to Penal Law Section 140.20, a class D felony, in that he, the said Josia G. Culver, on or about the 10th day of April 2023, knowingly and unlawfully entered into a building, to wit: Panda Chinese Restaurant, located at 43 Batavia City
Center, in the City of Batavia, County of Genesee, State of New York, with intent to commit a crime therein.
COUNT TWO:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Josia G. Culver, of the crime of CRIMINAL MISCHIEF IN THE THIRD DEGREE, contrary to Penal Law Section 145.05(2), a class E felony, in that he, the said Josia G. Culver, on or about the 10th day of April 2023, with intent to
damage property of another person and having no right to do so nor any reasonable ground to believe that he had such right, he damaged property of another person in an amount exceeding two hundred and fifty dollars, to wit: the entrance door of Panda Chinese Restaurant located at 43 Batavia City Center, in the City of Batavia, County of Genesee, State of New York.
COUNT THREE:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Josia G. Culver, of the crime of PETIT LARCENY, contrary to Penal Law Section 155.25, a class A misdemeanor, in that he, the said Josia G. Culver, on or about the 10th day of April 2023, while at Panda Chinese Restaurant located at 43 Batavia City Center, County of Genesee, State of New York, did steal property belonging to another, to wit: $120.00 in U.S. currency.
COUNT FOUR:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Josia G. Culver, of the crime of BURGLARY IN THE THIRD DEGREE, contrary to Penal Law Section 140.20, a class D felony, in that he, the said Josia G. Culver, on or about the 14th day of April, 2023, knowingly and unlawfully entered into a building, to wit: Pok-A-Dot restaurant, located at 233 Ellicott Street, in the City of Batavia, County of Genesee, State of New York, with intent to commit a crime therein.
COUNT FIVE:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Josia G. Culver, of the crime of CRIMINAL MISCHIEF IN THE FOURTH DEGREE, contrary to Penal Law Section 145.00(1), a class A misdemeanor, in that he, the said Josia G. Culver, on or about the 14th day of April, 2023, while at the Pok-A-Dot restaurant, located at 233 Ellicott Street, in the City of Batavia, County of Genesee, State of New York, having no right to do so nor any reasonable ground to believe that he had such right, intentionally damaged property of another person, to wit: the exterior glass door.
COUNT SIX:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Josia G. Culver, of the crime of BURGLARY IN THE THIRD DEGREE, contrary to Penal Law Section 140.20, a class D felony, in that he, the said Josia G. Culver, on or about the 16th day of April, 2023, knowingly and unlawfully entered into a building, to wit: Panda Chinese Restaurant, located at 43 Batavia City Center, in the City of Batavia, County of Genesee, State of New York, with intent to commit a crime therein,
COUNT SEVEN:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Josia G. Culver, of the crime of CRIMINAL MISCHIEF IN THE THIRD DEGREE, contrary to Penal Law Section 145.05(2), a class E felony, in that he, the said Josia G. Culver, on or about the 16th day of April 2023, with intent to
damage property of another person and having no right to do so nor any reasonable ground to believe that he had such right, he damaged property of another person in an amount exceeding two hundred and fifty dollars, to wit: the entrance door of Panda Chinese Restaurant located at 43 Batavia City Center, in the City of Batavia, County of Genesee, State of New York.
COUNT EIGHT:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Josia G. And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Josia G. Culver, of the crime of ATTEMPTED BURGLARY IN THE THIRD DEGREE, contrary to Penal Law Sections 110.00 and 140.20, a class E felony, in that he, the said Josia G. Culver, on or about the 4th day of May, 2023, knowingly attempted to enter or remain unlawfully in a building, to wit: the Panda Chinese Restaurant located at 43 Batavia City Center, County of Genesee, State of New York, with intent to commit a crime therein.
COUNT TEN:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Josia G. Culver, of the crime of CRIMINAL MISCHIEF IN THE THIRD DEGREE, contrary to Penal Law Section 145.05(2), a class E felony, in that he, the said Josia G. Culver, on or about the 4th day of May, 2023, with intent to damage property of another person, and having no right to do so nor any reasonable ground to believe that he had such right, he damaged property of another person in an amount exceeding two hundred and fifty dollars, to wit: the entrance door of Panda Chinese Restaurant located at 43 Batavia City Center, in the City of Batavia, County of Genesee, State of New York.
COUNT ELEVEN:
And The Grand Jury Aforesaid, by this Indictment, further accuses the said, Josia G. Culver, of the crime of CRIMINAL MISCHIEF IN THE THIRD DEGREE, contrary to Penal Law Section 145.05(2), a class E felony, in that he, the said Josia G. Culver, on or about the 5th day of May 2023, with intent to damage
property of another person and having no right to do so nor any reasonable ground to believe that he had such right, he damaged property of another person in an amount exceeding two hundred and fifty dollars, to wit: the ATM belonging to Bank of America located at 21 Bank Street, in the City of Batavia, County of Genesee, State of New York.
