Cole told the court that as of September 18th, 2025, the following building have been demolished, 3, 4, 5, 6, 8, 9, 10, 21, the elevator and sky bridge. Building 13 is nearly finished and building 20 has been started.

“Next is site cleanup and debris removal which will be done by the end of this month,” Cole says.

Demolition started on the buildings over the summer.

Cole then requested a compliance date for November 24th at 1:00p.m.

Judge Rogers then asked Cole what buildings are remaining?

Cole replied that as of September 18th, 2025, the following buildings remain:

Buildings 1,2,7,11,12,13,14,15,16,17,18,19,22,23,25,43, and 47. Judge Rogers also asked about the fencing around the project. Cole replied that fencing was in place and that no attempt has been made to breach the fence and there is no damage to the fence.

Judger Rogers then asked the attorney representing the City, David Fitch, if he would agree to do an off-calendar withdrawal of charges instead of the November 24th appearance. Fitch agreed based on the fact that the Harvester owners are in compliance, raising all of the buildings and removing the debris, and then went further, saying that all the charges, 6 counts on 3 buildings, would be removed.

If the off-calendar withdrawal is received from the City between now and November 23rd, the court date will not be needed.
