BATAVIA POLICE REPORT/Bank street man accused of assaulting an employee at a business

Joseph D. Berry, 32, of Bank St., Batavia, is charged with assault 3rd/intent to cause injury, after allegedly assaulting an employee at a business on West Main street on July 29, 2018 at 4:04a.m.

Berry was arraigned in City Court and jailed on $1,500 cash or bond bail.

He will appear in court again today at 1:30p.m.

 

Jeffery D. Torrey, 46, of McKenzie St., Bergen, is charged with endangering the welfare of a child after allegedly attempting to use a hole punch to pierce the ear of a child less than 17 years old at an address on Ross street on July 5, 2018.

Torrey was issued an appearance ticket and will appear in City Court on July 31, 2018 at 1:00p.m.

 

 

John J. Caez-Gonzalez, 31, homeless, is charged with criminal contempt 1st, aggravated family offense and criminal possession of a controlled substance 7th after a domestic incident on State street on July 28, 2018.

Caez-Gonzalez  allegedly violated a complete stay away order of protection and at the time of his arrest was found to be in possession of heroin.

He was arraigned and jailed without bail.

 

 

Jason R. Duffina, 41, of Porter Ave., Batavia, is charged with petit larceny following an incident at Tops Supermarket at 390 West Main street on July 24, 2018.

Duffina allegedly stole merchandise from Tops and attempted to leave the store, failing to pay for the property.

He was issued an appearance ticket and will appear in City Court on August 7, 2018 at 1:00p.m..

 

 

Kevin Watson, 58, of West Main St., Rochester, NY, was picked up from the Monroe County Jail on an active bench warrant for petit larceny after being released on unrelated charges.

The incident occurred on March 17, 2018 and Watson was arraigned in City Court on July 26, 2018.

He was jailed in lieu of $1,000 bail and is due to re-appear in court on August 1, 2018.

 

 

Cynthia D. Gause, 47, of Eaton St., Buffalo, is charged with DWI following a police investigation into a complaint of an employee arriving at work in an intoxicated condition on Bank street on July 28, 2018.

Gause was arraigned in the Town of Batavia Court and remanded to the jail with bail set.

She will appear in City Court today.

 

 

Kevin W. Howard, 18, of Bank St., Batavia, is charged with DWAI/Drugs, unsafe tires, unlicensed operator and failure to obey a traffic device after a traffic stop o Main street on July 26, 2018.

Howard was observed traveling on Main street with an unsafe tire. He then entered a parking lot, traveling the wrong way through an exit only.

Howard was found to be operating without a license and under the influence of drugs. He was released with traffic tickets and will appear in City Court on August 29, 2018 at 9:00a.m.

 

 

James Haynes, 31, of Taylor Terr., Chester, PA, was arrested on two warrants out of City Court after being extradited from Pennsylvania on July 27, 2018.

The warrants are from January 2007.

Haynes was arraigned in City Court and held on bail. He will re-appear in court on August 23, 2018 at 11:00a.m.

 

 

Anthony K. Wolcott, 32, of Willow St., Batavia, was arrested on Liberty street on July 24, 2018 at 8:38 a.m. on a bench warrant for failure to appear in City Court on a traffic charge.

Wolcott was released with an appearance ticket and will appear in court on July 31, 2018 at 1:00p.m.

 

 

Dina Mercado, 37, of Old Falls Blvd., N. Tonawanda, was arrested on an outstanding bench warrant out of City Court for failing to appear for traffic tickets that were issued to her on January of 2017.

Mercado was arraigned in City Court and jailed in lieu of $500 bail.

She will return to court on August 16, 2018 at 9:30a.m.
