PERRY POLICE REPORT/Leicester man charged in traffic stop

PERRY, NY- Chief Michael J. Grover reports the arrest of a Leicester resident on several charges following a DWI investigation by the Perry Police Department.

On January 16, 2022, at approximately 1:15 am, Officer Spencer Kramell conducted a traffic stop on State Route 39 at Rider Road for multiple vehicle and traffic law violations that were observed on Water Street in the Village of Perry. Upon interacting with the suspect, 45-year-old Dean L. Smith Jr. of Leicester, New York, Officer Kramell suspected Smith to be intoxicated. Officer Kramell requested Smith submit to standardized field sobriety tests, which he complied. After verbal admissions by Smith and not performing the tests as instructed, Smith was arrested for Driving While Intoxicated.

Smith was transported to Perry PD for processing and a chemical breath test, which Smith voluntarily submitted to. The chemical test revealed that Smith had a BAC of .11%. Smith was released to a sober third party per NYS bail reform laws and is to appear in Perry Village Court on 02/08/2022 for the below charges.

Vehicle and Traffic Law-375(30)-Drivers View Obstructed

Vehicle and Traffic Law- 1192-3 DWI-Common Law

Vehicle and Traffic Law-1192-2 DWI BAC .08% of 1% or higher
