After patrol observed a vehicle off the roadway on Route 39 in the Town of Arcade on February 9, 2022, the owner/operator Brian J. Kelly, 38, of Nunda, NY, was arrested for aggravated unlicensed operation 3rd degree, after it was determined he was allegedly operating his vehicle while his driving privileges were suspended.
Kelly admitted he had been operating a 2013 Dodge Ram eastbound on Route 39 when he lost control and drove off the roadway. Kelly is also charged with unlicensed operator, failure to keep right and speed not reasonable and prudent.
The vehicle was towed away from the scene and Kelly was released on an appearance ticket; he will appear in the Town of Arcade Court on February 24, 2022.
