1. Justin T. Calmes, 45, of Watson Street, Batavia, NY, is charged with open burning. On 05/28/2023, Officer Moscicki arrested Calmes for open burning. It is alleged that on 05/26/2023, Calmes had a fire in violation of the Batavia Municiple Code while at a Watson Street address. Calmes had, earlier in the night, been previously advised of the Batavia Municiple Code violation. Calmes was issued an appearance ticket to appear in Batavia City Court on 6/06/2023.
2. Ricky L. Miller, 41, of State Street, Batavia, NY, is charged with petit larceny and harassment. On 5/24/23, Officer Quider arrested Miller on the above charges after an incident at a business on W. Main Street, where Miller attempted to steal approximately $400 in merchandise and after being confronted, shoved the store manager in an attempt to flee. Miller was issued an appearance ticket and is scheduled to appear in Batavia City Court at a later date.
3. Brinson M. Blocker, 29, of Barry Street, Brockport, NY, is charged with passing a red light and driving while intoxicated. On 5/21/2023, at about 2:29 AM, Police Officer Weglarski stopped Blocker for a vehicle and traffic violation. Upon investigation, it was determined that Blocker was allegedly driving while intoxicated. He was placed under arrest for DWI and transported to Batavia Police Headquarters. Blocker was arraigned in CAP court later that same morning. Status unknown.
4. Charles B. Lee, 47, of West Bergen Road, Bergen, NY, is charged with operating a motor vehicle while impaired by drugs. On 5/26/23, Officer Defelice arrested Lee on the above charge following an investigation on 09/29/2022 where he was allegedly operating a motor vehicle while allegedly impaired by drugs. The arrest was delayed pending the return of bloodwork from the lab. Lee was issued uniform traffic tickets and is scheduled to appear in Batavia City Court on 06/07/2023 at 9:00AM.
5. Nathan W. Campbell , 42, homeless, is charged with trespass. On 5/31/23, Officer Tucker arrested Campbell for trespassing at a business on East Main Street after he was banned from the location a few hours prior for causing a disturbance. Campbell was issued an appearance ticket to appear in Batavia City Court on 6/13/23 at 1:00 pm and released.
6. Nathan W. Campbell ,42, homeless, is charged with petit larceny. On 5/31/23, Officer Quider arrested Campbell at a business on East Main Street for petit larceny after he entered and stole beer. Campbell was arraigned in Batavia City Court and released on his own recognizance to reappear on 7/12/23 at 1:00 PM.
7. Matthew J. Wenzel, 36, of State Street, Batavia, NY, is charged with petit larceny. On 5/29/23, Officer Yung arrested Wenzel for petit larceny after he allegedly stole medication belonging to a family member. Wenzel was issued an appearance ticket to appear in Batavia City Court on 6/13/23 at 1:00 pm.
Felony Arrests
1. Mark E. Flaming, 33, of West Main Street Road, Batavia, NY, is charged with 2 counts of tampering with evidence, leaving the scene of a serious physical injury accident, improper plates, operating without proper license, operating without insurance, unregistered motor vehicle, and uninspected motor vehicle. On 5/27/23 Officer Freeman arrested Flaming on the above charges following an investigation into an accident that occurred on West Main Street on 5/26/23. Flaming allegedly fled the scene of a serious physical injury accident, tampered with evidence and violated multiple other vehicle and traffic laws. Flaming was issued an appearance ticket to appear in Batavia City Court on 5/30/23.
2. Josia GJ Culver, 18, of Tracy Avenue in Batavia, NY is charged with attempted burglary 3rd degree and criminal mischief 3rd degree. On 5/15/23, Det. Ivison arrested Culver on the above charges after an investigation into an attempted break in at a business located in the Batavia City Centre on 5/4/23. This is the third time in the past month Culver has been arrested for breaking into the same business. Culver is currently being held in Genesee County Jail.
3. Adam B. Thomas, 34, of South Main Street Batavia, NY, is charged with criminal mischief 3rd degree. On 5/28/23, Officer Yung arrested Thomas for criminal mischief 3rd degree. Thomas allegedly damaged family property at his residence. Thomas was transported to Genesee County Jail for Centralized Arraignment Part Court. Status unknown.
4. Richard A. Demmer Jr.,30, no known address, is charged with attempted robbery 3rd degree. On 5/29/23, Officer Yung arrested Demmer for attempted robbery 3rd degree. It is alleged that Demmer attempted to rob a local convenience store. Demmer was arrested and arraigned in Centralized Arraignment Part Court and released on his own recognizance to appear in Batavia City Court on 6/20/23 at 2:00 pm.
Warrant Arrests
1. Jaqulyn A. Dueppengiesser, 39, of Page Road, Perry, NY, was arrested on two warrants for failing to appear. On 5/25/23, Officer Martinez arrested Dueppengiesser on two warrants issued by Batavia City Court for failing to appear. Officer Martinez located her in a dumpster after Batavia Police received a call for a suspicious condition at a local business The first warrant stems from a criminal possession of a controlled substance 5th charge (D Felony) arrest on 4/11/23 where Dueppengiesser was arraigned in Batavia City Court and released under the supervision of Genesee Justice pending her next appearance. The second warrant stems from a petit larceny arrest on 5/09/23 where she was issued an appearance ticket. She failed to appear on both arrests, prompting the two warrants. Dueppengiesser was arraigned in Batavia City Court on the warrants and released on her own recognizance.
2. Adam J. Montes, 39, address unknown, was arrested on a bench warrant for failing to appear. On 5/31/23, Officer Martinez arrested Montes on a Batavia City Court Bench Warrant that was issued for failure to appear. Montes was originally arrested for grand larceny of a vehicle and conspiracy 5th degree on 2/27/23. He was then arrested on 4/06/23 on a Bench Warrant for failure to appear before the most recent warrant arrest. Montes was arraigned in Batavia City Court and held with no bail until his appearance on 7/12/23 at 1:00 pm.
3. Rosemary R. Waters, 37, of East Main Street, Batavia, NY, was arrested on two Batavia City Court bench warrants for failure to appear. On 5/17/23, Officer Girvin arrested Waters on two warrants issued by Batavia City Court for failing to appear. The warrants stem from two incidents. The first incident occurred on 8/17/2021 at a hotel on Oak Street where Waters was arrested on an unrelated warrant. As part of the arrest, narcotics, a modified fully automatic 9mm pistol and a 40 round magazine were recovered. Waters was released prior to the return of lab work and an arrest warrant was issued. She was arrested on the arrest warrant on 4/07/23, status unknown. The second incident occurred on 7/30/22. It is alleged that Waters was a passenger in a vehicle during a traffic stop on Mix Place in Batavia. Waters provided a false name and was released. Narcotics and a modified short barrel shotgun were later located in the vehicle. Subsequently, an arrest warrant was issued. She was arrested on the arrest warrant on 4/7/23, status unknown. Waters was arraigned in Batavia City Court by Judge Burns and held on $5,000/$10,000/$40,000 bail until her appearance in Batavia City Court on 5/30/23 at 1:00 pm.
4. Oraid W. Edwards, 39, of West Avenue, Rochester, NY, was arrested on an arrest warrant for failing to appear after being issued an appearance ticket. On 5/19/23, Officer Defelice arrested Edwards on an arrest warrant issued by Batavia City Court. The warrant stems from an incident at a residence on South Main Street on 6/19/22 where Edwards was allegedly found sleeping on the couch and was unknown to the residents. Edwards left prior to patrols arrival. He was arrested for trespassing on 6/23/22 and issued an appearance ticket. An arrest warrant for failing to appear after being issued an appearance ticket was issued on 8/23/22. Edwards was arraigned in Batavia City Court and released on his own recognizance to appear in Batavia City Court on 6/1/23 at 1:30 pm.
5. Stephen D. Freeman, 52, of Mcmahon Road, Hinsdale, NY, was arrested on an arrest warrant for petit larceny. On 5/28/23, Officer Weglarski arrested Freeman on an arrest warrant issued by Batavia City Court for petit larceny. Freemen was arrested by a NYS Troopers in Cattaraugus County and turned over to the Batavia Police Department. It is alleged that Freemen stole from an employer located in the Batavia City Centre around 9/15/22. Freemen was arraigned in Centralized Arraignment Part Court and released on his own recognizance to appear in Batavia City Court on 6/13/23 at 1:00 pm.
6. Adam D. Altobelli, 42, of Mount Hope Boulevard, Rochester, NY, was arrested on a bench warrant for failing to appear. On 5/24/23, Officer Messmer arrested Altobelli on a bench warrant issued by Batavia City Court for failing to appear. The warrant stems from an incident on 2/22/20 at a business on East Main Street where it is alleged that Altobelli was arrested for stealing items (petit larceny) and was found to be in possession of a controlled substance (criminal possession of a controlled substance 7th). Altobelli was issued an appearance ticket and failed to appear, prompting an arrest warrant for failing to appear after an appearance ticket issued. Altobelli was arrested on the arrest warrant on 12/04/20 and arraigned in Batavia City Court where he was released under the supervision of Genesee Justice. Altobelli failed to appear and a bench warrant was issued upon which he was arrested on 5/06/21, arraigned in Batavia City Court and released under the supervision of Genesee Justice again. Altobelli failed to appear and another bench warrant was issued upon which he was arrested on 8/30/21, arraigned in Batavia City Court and again released under the supervision of Genesee Justice. Altobelli failed to appear resulting in this most recent bench warrant arrest. Altobelli was arraigned in Centralized Arraignment Part Court, status unknown.
7. Carlos E. Flores, 31, of Dewey Avenue, Greece, NY, was arrested on a bench warrant. On 5/25/23, Officer DeFelice arrested Flores on a bench warrant issued by Batavia City Court for failing to appear. The originating incident occurred on 8/11/19 at a location on Bank Street. Flores is alleged to have threatened another person after which he was arrested and issued an appearance ticket for harassment second. Flores was arraigned in Batavia City Court where he was released after entering a guilty plea.
